1.Who registers your domain
Scale is a reseller. Domains you buy in Scale are registered by our registrar partner, [the registrar: today the plan is Tucows Domains Inc., through its OpenSRS service; the code can also work with Namecheap or Name.com]. The registrar is accredited by ICANN. Scale is not. You can ask us which registrar holds your domain at any time, and the registrar is named in your domain's public records.
These terms are part of the Terms of service.
2.Registration agreement and your rights
When you register a domain, you also agree to the registrar's registration agreement, which for Tucows is the Tucows domain registration agreement [update the link if the registrar changes], and the rules of the registry for that ending, like .com. Read ICANN's Registrant Benefits and Responsibilities and Registrant Educational Information. [Mike: confirm both ICANN links and the exact flow downs Tucows requires of resellers.] We keep a record of when you agreed.
3.The domain is yours
Domains are registered in your business's name, as the registrant. You can move your domain to another registrar whenever the rules allow.
Buying domains in Scale is not live yet. Until it is, the suite only simulates a purchase and labels it clearly.
4.Prices
We show the price for the first year and for renewal before you buy. Renewal prices can change, and we show the new price before a renewal is charged. Domain fees are not refundable once a registration or renewal is submitted. Founders pricing does not apply.
5.Renewals and notices
Domains renew every year unless you turn renewal off. Expiration notices are sent by email to the domain's contact about 30 days and 5 days before a domain expires, and about 3 days after it expires. If a renewal fails or is off, the domain may stop working when it expires and can be lost. A domain that has expired may cost more to get back, if it can be got back at all. [Confirm grace and restore fees from the registrar price list.]
6.Accurate contact details
Keep the contact details on your domain accurate and current. The registrar may email you to confirm them. If you do not respond, the registrar may suspend the domain. Some details may be published in public domain records where the rules require it. Privacy protection is used where the registry allows it.
7.DNS and other records
Domains in Scale use our managed DNS. With your OK, Scale adds the records your Sites and Mail need, including SPF, DKIM and DMARC for email. You can see and change your records in Domains.
8.Transfers
You can get a transfer code for your domain in Domains and move it to another registrar. Registry and ICANN rules may block a transfer for 60 days after you register a domain, transfer it, or change its owner. [Confirm current ICANN transfer policy timing.]
9.Disputes about a domain name
Disputes about who has the right to a domain name follow ICANN's Uniform Domain Name Dispute Resolution Policy and the registry's rules. The registrar may act on a decision under those rules.
10.Abuse and suspension
Do not use a domain for phishing, malware, spam or anything the Acceptable use policy forbids. The registrar, the registry or Scale may suspend a domain used that way, or as the law or the rules require.
