1.Our policy

We respect the rights of creators and expect everyone on Scale Suite to do the same. We respond to notices that follow the Digital Millennium Copyright Act (17 U.S.C. 512). This covers content we host for businesses, like websites built with Sites, Market listings and templates, files shared from Drive, and booking and pay pages.

3.What a notice must include

  • your physical or electronic signature
  • the work you believe is infringed, or a list if there are several
  • the material you believe infringes, and where it is on Scale Suite, such as a link
  • your name, address, phone number and email
  • a statement that you believe in good faith that the use is not authorized by the owner, its agent or the law
  • a statement that the notice is accurate and, under penalty of perjury, that you are the owner or allowed to act for the owner

We may share your notice with the business that posted the material.

4.What happens next

When we get a complete notice, we remove or disable the material promptly and tell the business that posted it, with a copy of the notice.

5.Counter notice

If your material was removed and you believe it was a mistake or misidentification, send a counter notice to the same agent with:

  • your physical or electronic signature
  • the material that was removed and where it was before
  • a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification
  • your name, address and phone number, and a statement that you consent to the jurisdiction of the federal court for your address, or if you are outside the U.S., any judicial district where Scale can be found, and that you will accept service from the person who sent the notice

We send the counter notice to the person who sent the original notice. We put the material back in 10 to 14 business days after we receive the counter notice, unless they tell us they have filed a lawsuit to stop it.

6.Repeat infringers

We close the accounts of businesses that repeatedly infringe. [Decision for Mike: for example, three valid notices within 12 months, with exceptions for notices later shown to be wrong.]

7.False notices

Anyone who knowingly makes a false claim in a notice or counter notice may be liable for damages under 17 U.S.C. 512(f). If you are not sure whether something infringes, talk to a lawyer first.

8.Trademarks and other complaints

For trademark, privacy or other complaints that are not about copyright, write to legal@scalembs.com. Report abuse under the Acceptable use policy.
