1.Sponsor and administrator
The sponsor of each raffle is the booth business named on that raffle, with its legal name and address shown on each raffle ("Sponsor"). The drawing is administered by Scale Modern Business Solutions LLC, 2415 San Ramon Valley Blvd, Suite 4, San Ramon, CA 94583 ("Scale"). Scale provides the platform and runs the drawing. Sponsor provides and delivers the prize. Apple, Stripe and any bank are not sponsors.
When Scale runs its own raffle, like the Passport raffle, Scale is both the sponsor and the administrator.
2.Who can enter
Open to legal residents of the 50 United States and the District of Columbia who are 18 or older, or the age of majority where they live if that is higher, when they enter.
Not open to the owners, employees and contractors of Sponsor or Scale, or members of their households. A business may enter through one authorized person. Void where prohibited or restricted by law.
3.When to enter
Entries open and close at the dates and times shown on each raffle, in Pacific time (the "Entry Period"). Scale's clock is the official clock.
4.How to enter
In Market: open the raffle at the booth and tap Enter free.
Free entry without a Scale account: use the free entry page shown on each raffle, fill in your name, email and business name (optional), and submit. You do not need an account or a subscription. Both ways have the same chance of winning.
Limit: one entry per person and one entry per business, across both ways. Extra entries, entries made by bots or scripts, and entries that use more than one or a fake identity are void. Buying, following, sharing or reviewing never earns extra entries.
5.Drawing and odds
At the date and time shown on each raffle, in Pacific time, Scale randomly selects one winner from all eligible entries received, using a computer random selection process, and may show the drawing live in Market. The odds of winning depend on the number of eligible entries received.
6.The prize
One prize, as shown on each raffle, with its approximate retail value, which is no more than $500. Any service area, scheduling or expiration terms for the prize are shown on each raffle, and a prize that expires lasts at least 90 days.
No cash or other substitution, except that Sponsor may substitute a prize of equal or greater value if the stated prize is not available. The prize is not transferable.
7.Winner notice
Scale notifies the potential winner in the app and by email within 24 hours after the drawing. The potential winner must reply within 48 hours and may be asked to confirm eligibility.
If a potential winner does not reply, is not eligible, or cannot accept the prize, the prize may go to an alternate winner chosen at random from the remaining eligible entries, up to 2 alternates. Sponsor delivers the prize within 30 days after the winner confirms.
8.Taxes
The winner is responsible for any taxes. If the prize is worth $600 or more, Sponsor may ask for a completed IRS Form W-9 before delivering it and will file any tax forms the law requires.
9.Publicity
Where the law allows, Scale and Sponsor may show the winner's first name, last initial, business name and city in Market without further payment. Anything more needs the winner's consent.
10.Conditions
By entering, you agree to these rules and to the decisions of Scale, which are final on all matters about the drawing. Scale may disqualify anyone who tampers with entry or the drawing, or who breaks these rules.
If the drawing cannot run as planned because of a technical failure, fraud or another cause beyond Scale's control, Scale may cancel, change or pause it, and may draw from the eligible entries received before the problem, as the law allows.
11.Release and limits
To the extent the law allows, entrants release Sponsor, Scale and their owners, employees and agents from claims that come from entering, or from accepting or using the prize, except claims caused by their own gross negligence or willful misconduct. Nothing in these rules limits rights that the law does not allow to be limited.
12.Disputes
These rules are governed by California law. Any dispute about a raffle is handled as described in the Disputes section of the Terms of service: a 30 day informal step first, then the state courts in Contra Costa County, California, or the federal court for the Northern District of California, with small claims court available.
13.Privacy
Scale collects entry information to run the drawing and contact the winner, under the Privacy policy. Sponsor receives the winner's contact details, and the details of entrants who checked the optional box to hear from Sponsor. That box is never checked for you and never changes your chances. Entrants who did not check it are not contacted by Sponsor except about winning.
14.Winner list
For the name of a raffle winner, email legal@scalembs.com within 60 days after the drawing, or write to Scale at the address above. Scale keeps raffle records for at least 1 year.
